Without derogating from the above, the website, its web pages, the classification, arrangement, and presentation of information, advertisements, and newsletters sent by the Operator, including SMS messages and research findings contained therein (hereinafter: "the Content"), are the exclusive property of the Operator. It is strictly forbidden to copy, publish, distribute, or reproduce the Content, in whole or in part, in any manner, whether on a website, email, SMS, or any other medium, without prior written consent from the Operator.

The user acknowledges that violating this section (or any part thereof) will cause significant financial and non-financial damage to the Operator and its clients. In the event of a violation, the user agrees to pay the Operator a predetermined compensation of 1,000 ILS per violation without requiring proof of damage. This does not limit any other rights or remedies available to the Operator under these terms or any law.

11. Any employment agreement resulting from a job posting or website use is made directly between the parties involved, without any involvement or liability from the Operator, even if communication was facilitated through the Operator.
12. The Operator will not use users' personal information for purposes other than those specified in its privacy policy, which is an integral part of these terms. However, the Operator reserves the right to collect and analyze usage patterns to improve its services. Credit card details entered into the system are encrypted and secured according to strict international security standards.
13. The use of some or all services offered on this website may require payment. Fees and pricing are determined at the Operator’s discretion and will be published on the website from time to time.
14. Registration for the service requires entering the user's personal details, including credit card information for billing purposes.

16. The service is intended for "smart" phones that support internet browsing via the mobile device. The operator shall not bear any responsibility regarding the browsing service received by the user from their mobile operator. Additionally, the operator will not provide guidance or explanations on how to use the mobile device for internet browsing, including instructions on using the device for browsing, the cost of the browsing package, and/or the browsing service fees charged by the mobile operator, and/or the user’s ability to browse from their mobile device, and/or the quality and/or nature of the browsing services the user is entitled to receive from their mobile operator.

The user hereby declares that they acknowledge and agree that the ability to send a resume directly from their mobile device is conditional upon pre-uploading their resume on the website and verifying their identity via a matching mobile number. Accordingly, the user declares that they understand that the mobile phone number provided on the website at the time of registration is the number to which messages will be sent as part of the service and any other mobile service provided by the operator from time to time.
18. The service is for personal use only. The user agrees not to forward messages received on their mobile device to other mobile devices and/or third parties. The user acknowledges that forwarding a message received on their personal device to other mobile devices and/or third parties may result in incorrect identification within the system and expose their personal details and resume to unauthorized parties. For the avoidance of doubt, it is clarified that the operator shall not bear any liability for any damages incurred by the user and/or a third party as a result of a violation of these terms. The operator reserves the right to modify or terminate the service, in whole or in part, with or without notice to the user, and shall not be liable to the user or any third party for any damage and/or loss resulting from the termination of the service.
19. By purchasing a subscription, the subscriber agrees to pay the monthly service fees indefinitely until the service is canceled, as detailed in these terms of use. The subscriber may notify the operator of their desire to cancel the service at any time, subject to these terms. The service provided to the subscriber is personal and non-transferable.
20. As part of using the website, the user may create a profile (hereinafter: "the Profile"). The Profile serves as a compilation of the user's personal details (including contact information) and skills and includes various fields for completion. The operator may add, remove, or modify the information fields in the Profile from time to time. An initial Profile may be generated automatically by the operator's system based on the resume uploaded to the website. The user may confirm, edit, or complete their details to create their Profile. The Profile is dynamic, and any updates will be automatically reflected. The user may use the Profile to generate a resume for submission to potential employers. Each user is allowed to create and use only one Profile for their personal use.
21. Direct Messages – The operator may send you various messages through different means, depending on the permissions you grant and the preferences you set in the "My Settings" page. You may modify your preferences at any time regarding the messages you wish to receive and the means through which they are delivered. By entering an email address and mobile number in your Profile, you agree to receive such messages via these channels.
22. If the user has the option to upload a profile picture, by doing so, the user declares that they own all rights to the image and are authorized to upload and share it without any conditions or restrictions. The user assumes full and exclusive responsibility for the uploaded image. Once uploaded, the profile picture will be transferred to any employer to whom the user submits their resume. By uploading a profile picture, the user expressly consents to its transmission to any employer who receives their resume.
23. In addition to all terms of use stated herein, the following terms apply specifically to employers using the website and the operator’s services:

23.1 Candidate Status Updates – As part of the website's services, candidates can receive updates on the status of their application. Accordingly, candidates will receive an automated notification when an employer views their submitted information.

23.2 Employers are strictly prohibited from using the website and its services, including its content, functionalities, and platforms, for any purpose other than job postings and the actual recruitment process. Using the platform for promotion, marketing, or advertising of the employer or third parties is not allowed.

23.3 Job postings on the website must be for genuine job openings and cannot include fictitious positions. Employers are prohibited from posting job ads to build a resume database, trade resumes, or engage in any activity unrelated to filling the posted position.

23.4 Employers may not post multiple identical job listings at the same time.

23.5 Prices for operator-provided services directed at employers do not include VAT.

23.6 Job postings, campaigns, and other advertisements uploaded to the website may be subject to approval at the operator’s discretion.

23.7 Certain employer-purchased products, such as job listings, banners, and logos, may be subject to specific usage periods or expiration dates. These durations are determined according to the purchase terms set by the operator. The advertising or usage period cannot be paused or extended. Furthermore, an employer who removes a purchased product from the website before the end of the advertising or usage period is not entitled to a refund, credit, reimbursement, or any other compensation.

23.8 The operator reserves the right to suspend an employer’s use of the website and/or its services, whether paid or unpaid, if the employer fails to comply with these terms, payment obligations, or has an outstanding balance with the company. The operator has sole discretion in these matters.
24. The operator reserves the right to modify or terminate any of the services it provides, in whole or in part, with or without notice to the user. The operator also retains the right to make changes to content, information, and services offered on the website and/or mobile services at its sole discretion, without prior notice. This includes modifying job posting categories over time. Furthermore, the operator is not responsible for the content of job postings sent to users via email or text messages based on their preferences.
25. The operator may suspend a user’s access to the website and/or its services if the user violates any provision of this agreement. Additionally, the user shall indemnify the operator, its employees, managers, shareholders, or any other representatives for any damage, loss, lost profits, payment, or expense incurred—including attorney fees and legal costs—due to a violation of these terms of use.
26. The operator may offer promotions, discounts, and benefits at its sole discretion. Promotions and discounts cannot be combined.
27. The operator reserves the right to modify these terms and conditions at any time. Use of the services at any given time constitutes acceptance of the updated terms as they exist at that time.
28. This agreement shall be governed exclusively by the laws of the State of Israel.
